Terms of Service
Effective date: October 11, 2026
These Terms of Service (the “Terms”) govern your access to and use of HEAT, the software platform operated by Brand Heat Global LLC (“Brand Heat”, “we”, “us”) and available at app.brandheat.ai and related domains (the “Service”).
By creating an account or using the Service you agree to these Terms. If you use the Service on behalf of a company or brand, you represent that you have authority to bind it, and “you” refers to that company or brand.
1. What HEAT does
HEAT helps marketing teams detect cultural trends, turn them into creative ideas, produce pieces (images, videos and copy) with the help of artificial intelligence, publish approved pieces to social media accounts the brand owns, run paid campaigns on advertising platforms the brand connects, and measure the results.
Some features depend on third-party platforms (for example TikTok, Instagram, Meta, Google and YouTube). Their availability, limits and rules are set by those platforms and may change.
2. Accounts
- You must provide accurate information and keep your login credentials confidential.
- You are responsible for the activity that happens in your account and in the workspace of your brand.
- You must be at least 18 years old and able to enter into a binding contract.
- We may suspend or close accounts that violate these Terms or put the Service, other users or third parties at risk.
3. Connecting social media and advertising accounts
When you connect a third-party account (such as TikTok, Instagram, Meta, Google Ads or YouTube), you authorize HEAT to act on that account within the permissions you grant on the platform's own consent screen — for example, to publish a video you approved, or to read the performance of your posts and campaigns.
HEAT only publishes or spends money when a person in your workspace explicitly asks it to (for example by pressing “Post” or by turning on a campaign). Before posting to TikTok, you choose who can see the video, whether others can comment, duet or stitch, and whether the content is commercial, as required by TikTok.
You can disconnect an account at any time from the “Where they publish” section of the brand settings in HEAT or from the security settings of the platform. Your use of each platform remains subject to that platform's own terms and policies, including the TikTok Terms of Service, the TikTok Music Usage Confirmation and the TikTok Branded Content Policy.
HEAT uses YouTube API Services. By connecting a YouTube channel to HEAT you agree to be bound by the YouTube Terms of Service (https://www.youtube.com/t/terms), and Google's Privacy Policy (https://policies.google.com/privacy) applies to the information Google processes.
4. Your content
You keep all rights to the materials you upload (logos, product images, brand guidelines, copy) and to the pieces created for your brand in the Service (“Your Content”).
You grant Brand Heat a limited license to host, process, reproduce and transmit Your Content only as needed to provide the Service — for example, to generate a piece, to show it to your team, or to publish it where you asked.
You are responsible for Your Content and for having the rights needed to use it, including for any trademarks, music, likenesses or third-party materials it contains. You must not use the Service to create or publish content that is illegal, infringing, deceptive, hateful, sexually explicit, or that violates the rules of the platforms where it is published.
5. Content generated with artificial intelligence
Ideas, images, videos and copy produced by the Service are generated with the help of third-party AI models. AI output can be inaccurate, similar to content generated for others, or unsuitable for your purpose. You must review every piece before publishing it.
Where a platform requires it, HEAT labels posts as AI-generated content. You must not remove or misrepresent those labels.
6. Acceptable use
- Do not use the Service to send spam, to impersonate any person or brand, or to publish to accounts you are not authorized to manage.
- Do not attempt to access other workspaces, reverse engineer the Service, bypass its limits, or interfere with its security.
- Do not use the Service to collect personal data about social media users beyond what the connected platforms allow.
- Do not use the Service in a way that violates any applicable law or the policies of the connected platforms.
7. Plans, credits and payment
Some features are available only under a paid plan and consume monthly credits. Plan prices, credits and billing terms are those agreed with you in writing or shown at the time of purchase.
Money spent on advertising platforms through campaigns you turn on is billed by those platforms directly to your advertising account and is not part of HEAT's fees.
8. Third-party services
The Service relies on third-party providers (for hosting, databases, AI models, payments and the social media platforms you connect). We are not responsible for the availability or acts of those providers, and their terms apply to your use of their services.
9. Intellectual property
The Service, including its software, design and the HEAT name and logo, belongs to Brand Heat and its licensors. These Terms do not grant you any right to them other than the right to use the Service as described here.
10. Disclaimers
The Service is provided “as is” and “as available”. To the maximum extent permitted by law, Brand Heat disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not guarantee any particular reach, engagement or advertising result.
11. Limitation of liability
To the maximum extent permitted by law, Brand Heat will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability arising from the Service will not exceed the amounts you paid to Brand Heat for the Service in the twelve (12) months before the event giving rise to the claim.
12. Termination
You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms, if required by law, or if a connected platform requires it. On termination, the license you granted us ends, except as needed to comply with law or to keep records described in our Privacy Policy.
13. Changes to these Terms
We may update these Terms. If a change is material, we will notify you through the Service or by email before it takes effect. Continuing to use the Service after the change means you accept the updated Terms.
